1. Agreement to Terms

By accessing our website at GCMS.ca and using our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Description of Service

GCMS.ca acts as a third-party representative to request Global Case Management System (GCMS) notes from Immigration, Refugees and Citizenship Canada (IRCC) under the Access to Information and Privacy (ATIP) Act on your behalf. We are not affiliated with the Government of Canada or IRCC.

3. Processing Times and IRCC Delays

While IRCC is legally mandated to respond to ATIP requests within 30 days, extensions and delays frequently occur. GCMS.ca does not guarantee delivery within 30 days. We are responsible for submitting your request promptly and accurately, but we cannot control IRCC's processing times. Refunds will not be issued for delays caused by IRCC.

4. Accuracy of Information

You are responsible for ensuring that all information provided to us, including your UCI, Application Number, and the signed IMM 5744 form, is accurate and complete. If a request is rejected by IRCC due to incorrect information or an invalid signature provided by you, a new request may require an additional fee.

5. Refund Policy

Refunds are only issued if we have not yet submitted your request to IRCC. Once your ATIP request has been officially filed with the government, the service is considered rendered, and no refunds will be provided, regardless of the outcome or contents of the notes.

6. Premium Translation Service

If you purchase the Premium package, we will provide a plain-language summary of your notes using AI-assisted tools. This summary is for informational purposes only and does not constitute legal or immigration advice. We strongly recommend consulting a registered immigration consultant or lawyer for complex issues.

7. Data Handling and Privacy

We collect and process your personal information solely to file and track your ATIP request. Sensitive identifiers (UCI and application number) are encrypted at rest, your signed IMM 5744 form is stored securely, and your identifiers and consent form are purged within 90 days of delivery. Payments are processed by Stripe; we never store your card details. By using the service you consent to receive transactional emails about your request.
