Yes โ but usually not by filing the request yourself. The right to make an Access to Information or Privacy Act request is limited to Canadian citizens, permanent residents, and individuals (or corporations) present in Canada. If you're a foreign national physically outside Canada, you generally can't file directly. Instead, you authorize someone in Canada to request your GCMS notes on your behalf, using a signed IMM 5744 consent form.
Who can request notes for you
- A Canadian citizen or permanent resident you trust โ a friend, family member, or your representative โ can file the ATIP request for you.
- A representative (such as a licensed consultant, lawyer, or an ATIP service) can submit it on your behalf.
